But many times after you hire a trademark attorney for a more comprehensive search, they still manage to find a conflict. That puts you right back where you started.
Going through this process until you find a strong and available name may seem like an uphill battle. For years I have had clients ask me “what makes a good, strong trademark?” Or in many cases, they have just asked me to come up with a good name for them. Introducing… Trademark Discovery!
With Trademark Discovery, I will assist you in finding a name for your business or product. Here is what this process will look like:
- An initial conversation where we discuss what your product/service is, what you want to convey with your name, and any other requirements that you may have for a name;
- Email correspondence in which I will provide 5-7 potential names (without exact USPTO conflicts);
- Follow-up consultation (up to 30 minutes) where we discuss which name(s) you prefer and/or brainstorm additional names if necessary.
This will give you several potential marks to choose from. From here, we will probably want to proceed with a comprehensive search on your chosen mark. This service does not include a comprehensive federal trademark search. However, I will use the TESS Search to make sure that there is not an exact hit before I submit name ideas to you.
